Lewisville police say two pedestrians were struck by a vehicle while crossing a street Monday night.

A driver hit two pedestrians trying to cross Fox Avenue at about 6:45 p.m., police say. Both victims have been airlifted to Parkland Hospital. 

Lewisville police tell NBC 5 that both victims are in critical, but stable condition, at Parkland.

Police say the two pedestrians were struck crossing Fox Avenue, near Edmonds Lane, in an area without a crosswalk. 

The two victims were hit by the driver of a 2002 Kia Sedona, police say. 

The driver, whose name has not been released, stopped and waited for police to arrive and is fully cooperating with the investigation. 

Lewisville police are working to identify the two victims and notify their  families.

No Recall on IKEA Glass Desks After Rare Breakage Reports

The Consumer Product Safety Commission has received reports of at least seven tempered glass desks from IKEA spontaneously shattering.  While no recall has been issued, NBC 5 Investigates Consumer Unit looked into why the desks, which do not all have the same design, are breaking and what's being done.

One of the CPSC reports came from Honey Grove resident Kayla Hall.  She came home from work several weeks ago to find her IKEA glass desk had spontaneously shattered.  Pieces were everywhere, she said, in every corner of the room, on top of other furniture and even in the hallway.

 "Pieces had gone under the door into the closet, which is across the room.  Anywhere it could get, it pretty much was," Hall said.

Hall bought the desk months before, which was black and clear with images of butterflies and flowers, at IKEA in Frisco. 

"IKEA had the best prices," said Hall. "And I liked the style of the things they had.  And when I saw that desk it had the flowers and the butterflies.  I thought this it's cute. It's girly. I like it."

Hall spent hours every day studying at the desk for her CPA exam.  She said she was thankful no one was home, her dogs were in their crates and no one was injured when the desk broke.

"No Way to Predict" When, If Tempered Glass May Fail

"There's really no way to predict when and where this is going to happen," said Lee Green, a professional engineer at Goodson Engineering in Denton who studies things like glass failures. "You can have a glass table in service for two, four, 10 years before it finally fails."

But experts like Green said though these breakages are rare, there are typically explanations.  The most common reason is if the glass gets hit or nicked.  Even a tiny tap or nick can eventually cause the glass to break. But if a hit or nick or scratch can be ruled out, the other the reason tempered glass may spontaneously break is because there may be an impurity or inclusion left in the glass during the manufacturing process.

"They are microscopic flaws in the glass that can't be detected easily," explained John Waskow, also a professional engineer and the director of regional operations for Architectural Testing, a company with a Southlake facility that assesses whether glass in buildings meets safety standards.

These tiny flaws, while rare, occur in the tempering process, ironically the very same process that makes glass stronger and safer.

 "Roughly one percent of all glass produced can be expected to fail spontaneously at some point during its life," Waskow said.

Hall said nothing fell on her desk and she didn't believe it had any hits or nicks.
But to figure out why her desk broke would take a lot of time, and it would be costly, so she may never know the exact reason.  But her tempered glass desk did break as it was supposed to, into tiny chucks and not into sharp chards of regular glass.

NBC 5 contacted the CPSC about Hall's desk and the other IKEA desks.

"From the reports and pictures we received, the tempered glass broke into nugget-sized pieces as the standard requires. This raises a question about whether this is a quality or safety issue," said Alex Filip, a spokesman for the CPSC.

NBC 5 also contacted IKEA spokeswoman Mona Astra Liss, who said that IKEA'S glass has one of the most rigorous testing processes of the entire IKEA product range.

"Fragmentation tests are made daily at our process suppliers and are continuously followed up by our purchasing teams in quality reviews," Liss said in a statement.

The statement also said: "Sometimes the tension caused by a strike, a knock or a scratch stays in the glass. A very small impact can make the glass shatter, hours or even months later. This is why glass, at rare occasions, may seem to shatter for no apparent reason."
 
In an email to Hall, IKEA apologized and told her, "The safety of our customers is very important."

The letter went on to say that the company would file a report with its quality and safety group in Sweden.  IKEA also issued her a refund.

"It's just one of those things you don't think about when you're buying furniture.  You don't think that it could suddenly just blow up on you," Hall said.

The CPSC reviews every report filed on its website, SaferProducts.gov, and notifies the named manufacturer within five days of the report being filed, Filip said. So the agency encourages consumers with a product safety or standard concern to file a report.

"The more reports on SaferProducts.gov, the more information CPSC and other consumers have to evaluate a product safety issue. Details like the make, model and serial number of the product are very helpful when filing a report on SaferProducts.gov," he said.

Hall said she intends to steer clear of a glass when she looks to buy another desk.

"I definitely won't be going with glass again," Hall said.

Waskow, on the other hand, isn't concerned.  He told NBC 5, coincidentally, he has an IKEA glass desk with butterflies and flowers, just like the one purchased by Hall's, in his daughter's room.

"My daughter uses it and I have no issues or concerns with it," he said.

Man Kills Neighbors in Fight Over Dog Feces: Police

A couple was shot and killed Monday morning in an argument with their neighbor over dog feces, Dallas police say.

When officers arrived at the Sable Ridge Apartments around 8 a.m. Monday, they found two people, later identified as 32-year-old Michelle Jackson and 31-year-old Jamie Stafford, dead at the scene from apparent gunshot wounds. An infant inside the couple's apartment was not injured.

After talking with witnesses, police began searching for Chung Kim, a resident of the complex identified by residents as a man who lived in the unit below Stafford and Jackson and was seen leaving the complex after the shooting.

Police later located Kim in his black Lexus SUV on nearby Larmanda Street and took him into custody.

Investigators said the couple had been dumping dog feces on the patio and at the front door of Kim's apartment. During the dispute Monday morning, police said Kim pulled out a gun and shot Jackson as she stood on her balcony. Police said Kim then went upstairs and into the couple's apartment and shot Stafford as he jumped off the balcony while trying to escape. Police said Kim then stood over Stafford and shot him again.

Residents told NBC 5 DFW they heard arguing followed by several gunshots.

"I heard about eight or nine gunshots just go off, 'pow, pow, pow,' like three separate times. It was like, first there was two or three, then there was a pause for like 30 or 40 seconds and then there was another three or four shots, and there was a pause and a couple more shots," said resident Michael Issa.

"I waited for like three or four minutes and I ain't hear nothing. I came outside to smoke a cigarette and look upstairs, and there's feet hanging over my head," he added.

A friend of the victim said there had been several arguments over pets and noise. 

One neighbor, Yolanda Washington, spoke of the couple's children, including the infant who was home at the time of the shooting.

"When they come home today, their mother and their father is gone. Little baby — they call the newborn Little Mama — Little Mama is not going to never know her parents. She'll never know her parents. Never," said Washington.

Marissa Gonzales with Child Protective Services said they took temporary custody of a 1-month-old child found unharmed inside the apartment. CPS said there were three other children who were attending school at the time of the shooting. All of the children are now with relatives.

Authorities say the Iraq War veteran charged in the shooting deaths at a Texas gun range had threatened himself and his family in the past, according to police records.

Eddie Ray Routh is facing one count of capital murder and two counts of murder in the deaths of former Navy SEAL and "American Sniper" author Chris Kyle and his friend Chad Littlefield.

Kyle and Littlefield were shot and killed at a Texas gun range on Saturday.

NBC 5 DFW obtained police reports from Lancaster Monday that said Routh was admitted to a psychiatric hospital in September 2012, after his mother said he'd threatened to "blow his brains out."

Eddie Ray Routh, the man accused of killing "American Sniper" Chris Kyle and friend Chad Littlefield, is being held in segregated housing in the Erath Co. jail while his mental competency is under evaluation.

In the report, officers said they were called to a disturbance where Routh was threatening to kill himself and his family. Officers said they'd found Routh walking without shoes and a shirt and that he smelled of alcohol. According to police, Routh told them that he was a Marine veteran suffering from PTSD and that he was hurting and that his family didn't understand what he'd been through.

According to Routh's mother, who is quoted in the report, he became upset when his father said he was going to sell Routh's gun.

An earlier report from the Lancaster police, from May of 2012, indicated Routh's mother Jodi had called police after she said her son had taken nine bottles of pills from her home.

On Monday, Routh's attorney said his client was counseled as recently as Jan. 29 at a Dallas Veterans Affairs hospital and was taking medication.

Routh, a member of the Marine Corps Reserve, is being held at the Erath County Jail on $3 million bond. According to Erath County Sheriff Tommy Bryant, Routh is on suicide watch.

Safety Concerns Grow About Trinity River Dam

There is a rock dam along the Trinity River in Fort Worth that has been the site of three drownings in less than three years, including the death of a woman earlier this month.

The dam was where a 7-year-old boy and his father were rescued Saturday from what some have called a "deceptively dangerous" section of the Trinity River. The boy fell into the river and his father struggled to reach the shore from after jumping in after the child, according to a release from the Fort Worth fire department.

The dam has a section scooped out of its middle to allow kayakers to continue in with their journeys down the river.  But it has made for a tempting leaping spot for children, and some adults over the years.

It is a story Kirk Montgomery knows all too well.  

Montgomery, 50, saved a woman's life there in 2010. He happned to see a woman who had slipped and fallen in. Former Fort Worth Mayor Mike Moncrief issued a proclamation recognizing Montgomery for his actions.

"I was flattered being called a hero [by the Mayor]," Montgomery said. "But heroes aren't trying to be heroes.  All they're doing is the right thing."

Montgomery told NBC 5 the "right" thing to do is to install more and better signage at the Trinity Park in an effort to warn people about the dangers of walking on the dam.

There are currently four signs that suggest the danger of walking across the sam. Two read "Safety First" and are posted on either hillside leading down to the water. Another two are stamped onto the rocks that indicate "Do Not Walk" in a style similar to a crosswalk.

"A do not walk sign is not a danger sign. You see do not walk signs everywhere. So a child doesn't see danger in a do not walk sign," Montgomery said.

Chad Lorance, a spokesperson for the Tarrant Regional Water District told NBC 5 that his agency is considering adding more warning signs near the river, and perhaps making the wording on the signs more specific to the danger of crossing the dam.  

But something like installing a fence is out of the question, Lorance said. A fence could impede flood debris in the event of high water, Lorance said.
